New South Wales was the first place in the country to name AI, algorithms and automation in the Work Health and Safety Act. That part isn't being enforced yet. The duty underneath it already is — everywhere in Australia.
A one-hour online session on Teams. It runs once enough people register — add your name below. One minute on where this actually stands.
Its guidance on AI and digital technologies is plain: if you are a PCBU, you must manage the health and safety risks of AI and digital technologies as much as you reasonably can, just as you would with any other hazard or risk. That applies now, in every state and territory — it does not wait for a commencement date. New South Wales went further. The Work Health and Safety Amendment (Digital Work Systems) Act 2026 was assented on 18 February 2026 and is the first Australian law to name digital work systems — AI, algorithms, automation — in a WHS Act. Its operative provisions are not being enforced yet: commencement is by proclamation, no earlier than one month after SafeWork NSW publishes the first guidelines, and those guidelines have not been published. So there is no deadline to wait for. There is a duty you already hold, and a question worth being able to answer: where does software make a decision about a person in your business, and who decided that was safe? This page is general information about publicly available guidance and legislation. It is not legal advice.
A one-hour session on Microsoft Teams covering what this duty means in practice and what "reasonably practicable" looks like for AI. It is not scheduled yet — it will run once enough people have registered, and we will email you the date when it does. Everyone who attends receives a three-month trial of ERA Safety.
