These terms of use (“Terms”) govern your use of the ERA Safety website at erasafety.net, including our marketing and campaign landing pages (“the Site”), operated by Emergency Response Alliance Pty Ltd (“ERA”, “we”, “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Site.

1. Scope of the Site

The Site provides information about ERA’s emergency management products and services, and tools for contacting us and booking demonstrations.

The Site is not an emergency tool. If there is immediate danger, call 000 and follow on-site instructions.

The Site is intended for informational purposes only and should not be relied upon as a substitute for professional advice. Content about workplace health and safety, emergency readiness and compliance is general information that does not take your circumstances into account — WHS duties vary between jurisdictions and circumstances, and you should obtain your own advice before acting on anything published on the Site. Product descriptions and features may change without notice.

Use of the ERA application and platform is governed by separate Terms and Conditions presented when you download or sign up to those products. To the extent of any inconsistency relating to the products, those terms prevail.

2. User Responsibilities

  • You must provide accurate and complete information when submitting forms on the Site.
  • You must not impersonate wardens, emergency personnel, administrators or other people.
  • You agree not to use the Site for any unlawful or unauthorised purposes.
  • You must not interfere with or disrupt the Site, probe, scan, or test the vulnerability of the Site (except where permitted by law), or attempt to bypass security or access controls.
  • You must not scrape, harvest or systematically extract content or data from the Site without our prior written permission.
  • You must not upload or transmit viruses or other harmful code.

3. Privacy

The Site collects and uses personal information as described in our Privacy Policy, including cookies, analytics and advertising attribution. By using the Site, you consent to the collection, use and disclosure of your personal information in accordance with the Privacy Policy.

4. Intellectual Property

The Site and all related content, including but not limited to text, graphics, images, logos, tools and software, are the property of ERA or its licensors and are protected by intellectual property laws, including the Copyright Act 1968 (Cth).

You may view, download and print content from the Site for your personal use or for evaluating our products within your organisation. You may not otherwise reproduce, distribute, modify, or create derivative works of the Site or its content without prior written permission from ERA. Our trade marks and branding may not be used without our consent.

5. Third-Party Services and Links

The Site contains links to third-party websites and services, including the Apple App Store and Google Play. These links are provided for convenience only; we do not control or endorse those sites, and your use of them is subject to their own terms and privacy policies. We are not responsible for third-party services outside our control.

6. Limitation of Liability

The Site is provided “as is” and “as available” without warranties of any kind, either expressed or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

Australia / Australian Consumer Law: nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law (ACL) or other applicable law that cannot be excluded.

To the maximum extent permitted by law (and subject to the ACL), we exclude liability for indirect, incidental, special, consequential or exemplary loss arising from your use of, or inability to use, the Site. Where our liability cannot be excluded, it is limited (at our option) to resupplying the relevant information or services, or paying the cost of resupply, to the extent permitted by law.

7. Modifications

We may change, suspend or discontinue any part of the Site, or modify these Terms, at any time. Changes are effective upon posting the revised Terms on this page, and your continued use of the Site after the effective date means you accept the updated Terms.

8. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Governing Law

These Terms are governed by the laws of Western Australia, Australia, and you submit to the non-exclusive jurisdiction of the courts of Western Australia. Nothing in these Terms limits mandatory consumer protections that apply in your jurisdiction.
